Your estate plan represents one of the most significant collections of legal documents you will ever create. When thoughtfully crafted, an estate plan can ensure that your assets are safeguarded, your wishes are carried out, and your loved ones are protected. A misstep, however, in the estate planning process may have long-term consequences, especially since many elements of an estate plan do not take effect until you are no longer able to make changes. To help ensure that your New York plan is successful, the Long Island attorneys at Eghrari Wealth Training Firm discuss common estate planning mistakes to avoid.

  1. Ignoring the Possibility of Incapacity. Many people focus solely on planning for what happens after death and overlook the importance of preparing for a period of incapacity. If an illness or injury prevents you from managing your affairs or making medical decisions, someone must step in on your behalf. Without proper planning, your family members may find themselves in the middle of a costly and emotionally draining legal battle to obtain decision-making authority. A solid incapacity plan typically includes documents such as a Durable Power of Attorney, Healthcare Proxy, and Living Will. These tools allow you to appoint trusted individuals and clarify your preferences regarding medical treatment and financial management in advance.
  2. Putting Off the Creation of an Estate Plan. Many adults understand the importance of having an estate plan but still delay getting started. Whether the delay stems from being too busy, assuming it is unnecessary at a younger age, or simply feeling overwhelmed by the process, postponing the creation of your estate plan can leave you and your loved ones vulnerable. Accidents and illnesses can happen at any time. By preparing now, you can have peace of mind knowing that your affairs are in order and your loved ones are protected, regardless of what the future holds.
  3. Choosing Fiduciaries Without Careful Consideration. Your estate plan will likely require you to name several fiduciaries, such as an Executor to manage your estate after your death, a Trustee to administer any trusts you establish, or an Agent to act under a Power of Attorney. These roles carry significant responsibilities, including managing assets, paying debts, filing tax returns, and ensuring your instructions are followed. Choosing someone simply because you know and trust them is not always enough. The individuals you select should also have the temperament, skills, and availability to fulfill their duties responsibly. In some cases, appointing a professional, such as a corporate Trustee or estate administrator, may be the most prudent option.
  4. Using DIY Forms Instead of Professional Guidance. It can be tempting to download a generic form or use an online template to create your estate plan, especially if you believe your situation is simple. Unfortunately, these do-it-yourself solutions often result in vague or incomplete documents that do not fully comply with New York law. Worse, they can lead to conflicting instructions among documents or omit key elements of a comprehensive plan. Errors in a legal document may not come to light until after you are incapacitated or deceased—when it is too late to fix them. An experienced estate planning attorney will help you navigate the legal landscape, address your unique needs, and create a plan that accomplishes your goals effectively.
  5. Letting Your Estate Plan Become Outdated. Once you have created an estate plan, it is essential to revisit it periodically and make updates as necessary. Life changes such as marriage, divorce, the birth of a child, or the death of a beneficiary can significantly impact your plan. In addition, changes to tax laws or estate planning statutes may affect your documents’ effectiveness. Failing to update your plan can result in unintended outcomes, such as assets passing to the wrong person or an outdated fiduciary serving in a critical role. Review your estate plan every few years, or sooner if you experience a major life event, to ensure that it continues to reflect your current circumstances and wishes.
