Commack Probate Resources

Home / Commack Probate Resources

Eghrari Wealth Training Law Firm  provides representation to clients in Commack, NY.  We can offer assistance with preparing for what will happen at the end of life and can offer help with the creation of a legacy plan. We are also there to assist individuals who must go to probate court because they have a legal matter that has to be handled before a judge.

Clients may need to go to probate court if a deceased person (decedent) has passed away and has left assets behind to be transferred through intestacy law. Going to probate court may also be necessary if assets from a decedent will transfer in accordance with the terms of a last will and testament.  If problems arise during the trust administration process, those problems can also be handled in probate court. And, if someone has become incapacitated and is in need of a guardian, probate court is the likely place where a guardian can be appointed.

Eghrari Wealth Training Law Firm  understands the ins-and-outs of Commack probate law and we can put our considerable experience to work to help all those involved in probate. We help individuals who are seeking a guardian or conservator to be appointed for an incapacitated loved one. We also help heirs or beneficiaries who stand to inherit from the probate process, the executor of an estate who is in charge of overseeing the process, and anyone who wishes to contest a will that is being probated because they do not believe it is an accurate reflection of the wishes of the deceased.

To find out more about how a Commack probate lawyer at our firm can help you, give us a call. You can also read on to find some important Commack probate resources that could help you to be as prepared as possible for the probate process.

Other Probate Resources in Commack

Some of the other important resources that you may need when you go through the probate process in Commack include details on the state and federal estate taxes that may need to be paid after a death. Resources that will allow you to learn about state and federal estate tax rules include the following:

  • The New York State Department of Taxation and Finance: New York residents may need to pay estate tax to the state even if they fall below the federal threshold for owing estate tax. It is important to understand exactly what the state’s rules are so you can take steps to try to reduce or avoid estate tax when making your estate plan and so you can avoid problems with taxing authorities after a death.
  • The IRS website with frequently asked questions about estate tax: Estate tax rules on the federal level differ from state rules. Tax reform has resulted in a larger exemption going forward, but there may still be circumstances where estate tax is owed. You should visit the website of the IRS to find out what is considered part of your taxable estate and when estate tax may be due after your death.

There may be options available to you to try to reduce or avoid estate tax.  However, you will need to ensure you work with an experienced attorney to implement the right processes to save on estate tax. Eghrari Wealth Training Law Firm  can provide assistance in identifying the different legal tools that you can make use of in order to try to keep your estate tax bill low or to avoid paying this tax altogether.
