National Estate Planning Awareness Week

National Estate Planning Awareness Week (NEPAW) is a vital event that encourages individuals and families to reflect on the importance of estate planning. Established by a U.S. House of Representatives resolution in 2008, NEPAW takes place every year during the third week of October. During National Estate Planning Awareness Week, the Long Island attorneys at Eghrari Law Firm hope to raise public awareness about the necessity of estate planning and to emphasize how creating or updating your estate plan can protect your loved ones and ensure your wishes are honored.

Why Estate Planning Matters

Many people assume estate planning is only necessary for the wealthy or elderly, but this is a misconception. Estate planning is essential for anyone who wishes to have control over their assets, healthcare decisions, and the legacy they leave behind. Without a properly executed estate plan, state laws will dictate how your assets are distributed, which may not align with your personal wishes. Additionally, estate planning allows you to appoint guardians for minor children, designate healthcare proxies, and make critical financial and medical decisions in the event of incapacity.

Despite its importance, a significant portion of the population does not have an estate plan in place. According to a 2023 survey, nearly 60 percent of Americans do not have a Last Will and Testament. This lack of preparation can lead to unnecessary stress, legal complications, and financial burdens for your loved ones. NEPAW is an opportunity to take control of your future by creating or updating your estate plan.

How to Celebrate National Estate Planning Awareness Week

There are several meaningful ways to participate in NEPAW, whether you already have an estate plan or are just beginning the process. Here are a few ideas to help you get started:

  • Educate Yourself and Others: NEPAW is an excellent time to learn more about estate planning. Attend seminars, webinars, or workshops hosted by estate planning professionals. You can also share valuable information with friends and family, encouraging them to prioritize their own estate planning needs.
  • Review and Update Your Existing Plan: If you already have an estate plan, NEPAW is the perfect time to review it. Life changes such as marriage, divorce, the birth of a child, or the death of a loved one can all impact your estate plan. Make sure your Will, trust, and other documents accurately reflect your current wishes.
  • Consult with an Estate Planning Attorney: If you do not have an estate plan, NEPAW is an ideal time to consult with an experienced estate planning attorney. An attorney can help you navigate the complexities of estate planning, ensuring that your documents are legally sound and tailored to your unique situation.
  • Create an Estate Planning Checklist: Start by listing your assets, debts, and key documents such as insurance policies, retirement accounts, and property deeds. Identify the people you want to name as beneficiaries, guardians, or Executors, and consider your healthcare and financial directives.
  • Encourage Charitable Giving: NEPAW is also a time to think about leaving a charitable legacy. Including charitable donations in your estate plan can support causes that are important to you while providing potential tax benefits.

Creating or Updating Your Estate Plan During NEPAW

National Estate Planning Awareness Week is an excellent time to either create or update your estate plan. If you do not have an estate plan, this week provides the perfect motivation to take that crucial first step. By working with an estate planning attorney, you can establish a comprehensive plan that addresses your financial and personal goals. A well-crafted estate plan can include a Last Will and Testament, a trust, powers of attorney for healthcare and financial matters, and an advance healthcare directive.

If you already have an estate plan, NEPAW is an ideal time to review and update your documents. Changes in your life, such as marriage, divorce, the birth of a child, or a significant change in your financial situation, may require adjustments to your plan. Even if no major changes have occurred, it is still wise to review your plan every few years to ensure that it remains up to date with current laws and reflects your evolving wishes.

Updating your estate plan may involve revising your Will, updating beneficiary designations, or adding provisions to account for new assets or family members. It is also an opportunity to reconsider your choice of Executors, Trustees, and guardians, making sure they are still the best people to carry out your wishes.
